Terms of Service

Access to Zymera.ai is restricted to individuals aged 18 or over, or to legally constituted entities. By creating an account, you declare that you have the legal capacity to accept these Terms.

Registration requires a valid email address. You are responsible for keeping your login credentials confidential. Any activity carried out from your account is your responsibility.

You agree to provide accurate, complete information and to keep it up to date. Zymera reserves the right to suspend or terminate any account containing fraudulent information.

You must immediately notify Zymera at contact@zymera.ai of any unauthorised use of your account or any security breach of which you become aware.

The Platform operates on a credit system. Each generation type consumes a defined number of credits, varying according to the AI model selected and the complexity of the generation. The credit cost is displayed before any generation.

Credits can be obtained via: (i) a paid monthly subscription, or (ii) the purchase of additional credit packs.

Zymera offers several subscription plans whose characteristics (monthly credits, features, pricing) are detailed on the Pricing page. Subscriptions are billed monthly via our payment provider Stripe.

Subscriptions renew automatically on the anniversary date. You may cancel at any time from your account settings; cancellation takes effect at the end of the current subscription period.

Monthly credits included in a subscription expire at the end of each monthly period and are not carried over. Credits from additional pack purchases are valid for 12 months from the date of purchase.

All prices are in USD. Zymera reserves the right to modify its pricing at any time, with 30 days' notice by email for existing subscriptions. Price changes do not take effect before the next renewal.

You retain all intellectual property rights over the content (images, texts, audio/video files) you upload to the Platform ("User Content"). By uploading it, you grant Zymera a limited, non-exclusive, royalty-free, worldwide licence solely for the purpose of providing the service (processing, generation, display in your workspace).

You warrant that you hold all necessary rights over the User Content and that such content does not infringe any third-party rights.

Creations produced by the Platform from your instructions ("Generated Content") are attributed to you to the extent permitted by applicable law. You are free to use them for personal or commercial purposes, subject to compliance with these Terms, including the Acceptable Use Policy.

Zymera claims no ownership over Generated Content. However, Zymera cannot guarantee the originality or absence of similarity with third-party content, which is inherent in the operation of generative models.

The Platform, its source code, interfaces, brand, logos and all its components are the exclusive property of Zymera or its licensors. Any unauthorised reproduction, modification or exploitation is strictly prohibited.

By using Zymera.ai, you agree to:

• Comply with all applicable laws;
• Not infringe third-party rights;
• Use the Platform only for lawful purposes;
• Not attempt to circumvent the Platform's security measures or limitations;
• Comply with the Acceptable Use Policy incorporated herein by reference.

In particular, it is prohibited to:

• Generate illegal content (child sexual abuse material, terrorism, hate speech);
• Create non-consensual deepfakes depicting real individuals for defamatory, deceptive or pornographic purposes;
• Impersonate a real person or entity;
• Use the Platform to produce disinformation or propaganda;
• Scrape, reverse-engineer or automatically exploit the Platform;
• Share login credentials or resell access to the service;
• Overload the servers or disrupt the service (DoS attacks).

Zymera undertakes to provide the Platform with care and skill. However, the service is provided "as is" and Zymera does not warrant the absence of interruptions, errors or that the Generated Content will perfectly meet your expectations.

To the extent permitted by law, Zymera's liability shall not exceed the amounts actually paid by the user during the 3 months preceding the damage. Zymera shall not be liable for indirect damages, loss of profit or intangible losses.

You are solely responsible for the content you upload and the Generated Content you use or distribute. You agree to indemnify Zymera against any third-party claims arising from your use of the Platform.

Zymera endeavours to keep the Platform available 24/7 but cannot exclude interruptions for maintenance, technical incidents or force majeure events. Planned maintenance will be announced with reasonable notice.

These Terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before taking legal action. Failing agreement, the courts of competent jurisdiction in the district of Zymera SAS's registered office shall have exclusive jurisdiction.

Under French consumer law, any consumer may have recourse to mediation. We recommend a qualified consumer mediator.

These Terms, the Privacy Policy, the Acceptable Use Policy, the Cookie Policy and the Refund Policy constitute the entire agreement between the user and Zymera regarding use of the Platform.

If any provision of these Terms is found to be void or unenforceable, the remaining provisions shall remain in full force and effect.
